Terms of Service

1. Who We Are and Acceptance of These Terms

EZTap Manager is operated by EZTap PTY LTD ("EZTap", "we", "us" or "our"). These Terms apply to your use of EZTap Manager, our digital profile services, subscriptions, and features connected to EZTap NFC products. By creating an account, accepting these Terms during onboarding, purchasing a subscription, or continuing to use the service, you agree to these Terms and our Privacy Policy.

2. Eligibility and Accounts

You must be at least 18 years old to create and manage an EZTap Manager account. A parent or legal guardian may create and manage a profile for a child or another person in their care, including a Children's Medical profile. You must provide accurate information, keep your login details secure, and promptly tell us if you believe your account has been accessed without permission.

3. What EZTap Manager Does

EZTap Manager lets you create and manage digital profiles that can be opened through a compatible smartphone, profile link, QR code or EZTap NFC tag. Depending on your plan and profile type, features may include links, contact information, lead capture, analytics, profile password protection, protected links, Lost Mode, Privacy Mode, team features, Medical profiles and other profile templates. Some features may be added, changed, restricted, made unavailable or moved between plans over time.

4. Your Content and Public Profiles

You retain ownership of the content and information you add to your profile. You give EZTap a limited, non-exclusive licence to host, process, display and transmit that content only as reasonably necessary to operate, secure and improve the service.

You control what you publish. A profile may be viewable by anyone who has its URL, scans its QR code or taps a connected tag unless you enable an available privacy control. You are responsible for checking your public profile and deciding what information is appropriate to share.

Profile passwords and protected-link PINs improve access control, but no online security measure can guarantee that information will never be accessed, copied or disclosed by an authorised visitor or through circumstances outside our reasonable control.

5. Medical, Emergency and Children's Profiles

Medical and emergency features are provided as a convenience for displaying information you choose to enter. They are not a medical device, emergency service, medical advice, or a substitute for professional medical identification or emergency procedures.

You are responsible for ensuring medical and emergency information is accurate, current and appropriate to share. Do not rely solely on an EZTap tag or profile for critical medical information. Access may be affected by internet availability, device compatibility, NFC capability, outages, maintenance or other circumstances.

If you create a profile for a child or person in your care, you confirm that you are their parent, legal guardian or otherwise have lawful authority to provide and manage that information. Additional information about sensitive information is in our Privacy Policy.

6. Digital ID Features

Any Digital ID feature provided by EZTap is a convenience display of information supplied by you. It is not a government-issued identity document, does not replace an official document and must not be represented as one. You are responsible for ensuring you have the right to upload any identity document or image and for choosing what information you publish. Where available, use profile security controls when sharing identity-related information.

7. EZTap CTags and NFC Products

A CTag is a reusable physical NFC connection point that can open an EZTap profile or other configured destination on a compatible device. NFC performance depends on the receiving device, device settings, placement, network availability and other external factors.

Unless a product or offer expressly says otherwise, purchasing a physical tag does not transfer ownership of the EZTap software platform or guarantee permanent access to paid software features. A user may connect multiple compatible tags to the same profile where the service supports it.

You are responsible for tags after delivery, including keeping them secure. Lost Mode, Privacy Mode and cancellation controls can reduce risk but cannot physically recover a lost tag or guarantee that a finder will return it.

8. Subscriptions, Trials and Billing

Paid subscriptions are billed in Australian dollars at the price and billing interval shown before checkout. Payments are processed by Stripe. EZTap does not receive or store your full card number.
  • Subscriptions automatically renew until cancelled unless the offer states otherwise.
  • If a trial requires a card, the trial converts to a paid subscription at the disclosed price unless you cancel before the trial ends.
  • You can manage or cancel an active subscription through the billing controls provided in EZTap Manager or the Stripe customer portal.
  • Cancellation stops future renewal. Access to paid features may continue until the end of the already-paid billing period, unless the applicable offer or Stripe flow states otherwise.
  • Fees already paid are generally not refundable for change of mind, except where a refund or other remedy is required by law.

Business plans may be priced by seats or another usage measure shown at checkout. The account owner is responsible for authorised team members and for charges resulting from seat or plan changes they approve.

9. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or another applicable law. Where goods or services fail to meet a non-excludable consumer guarantee, you may have rights to a repair, replacement, refund, service cancellation or compensation depending on the circumstances.

10. Acceptable Use

You must not use EZTap to:
  • break any law, infringe another person's rights, or impersonate another person or organisation;
  • publish unlawful, fraudulent, deceptive, threatening, abusive or malicious content;
  • send spam, phishing material, malware or harmful code;
  • collect, use or disclose another person's information without a lawful basis or required consent;
  • probe, bypass, defeat or interfere with authentication, privacy controls, rate limits or security measures;
  • scrape or harvest the service at scale without our written permission; or
  • use the service in a way that could damage, overload or disrupt EZTap or another user.

11. Lead Capture and Business Use

If you enable lead capture or contact exchange, you are responsible for how you use information submitted by visitors. You must use it only for lawful purposes, respect the consent given by the visitor, comply with applicable privacy and marketing laws, and honour reasonable requests to stop contact or remove information.

12. Third-Party Services and Links

EZTap relies on third-party providers and infrastructure, which may include Base44, Stripe, email providers, analytics or AI-processing services. Your profile may also contain links to third-party websites. We do not control third-party services and are not responsible for their independent content, availability, policies or security. Their own terms and privacy policies may apply when you use them.

13. Service Availability and Security

We use reasonable technical and organisational measures to operate and protect EZTap, but no service can be guaranteed to be uninterrupted, completely error-free or completely secure. We may perform maintenance, respond to security issues, impose reasonable limits, disable compromised links or accounts, or make changes required to protect users and the platform.

14. Suspension and Termination

We may restrict, suspend or terminate access where we reasonably believe an account violates these Terms, creates a security or legal risk, is being used fraudulently, or where suspension is reasonably necessary to protect the service or other users. Where appropriate, we will try to provide notice or an opportunity to resolve the issue.

You can permanently delete your account from Settings. Account deletion requires identity verification and is intended to be irreversible. If an active subscription is connected to the account, EZTap attempts to cancel it before completing deletion. See the Privacy Policy for details about deletion and residual records.

15. Intellectual Property

EZTap Manager, the EZTap name, branding, software, interface, original designs and platform content are owned by or licensed to EZTap and protected by applicable intellectual property laws. Except as allowed by law or with our written permission, you may not copy, resell, reverse engineer, reproduce or distribute protected parts of the service.

16. Disclaimers and Limitation of Liability

To the maximum extent permitted by law, EZTap is provided on an "as available" basis and we exclude warranties that are not expressly stated in these Terms or required by law. We are not responsible for loss caused by circumstances outside our reasonable control, third-party services, information you choose to publish, or your failure to keep account credentials and profile information secure.

To the maximum extent permitted by law, EZTap is not liable for indirect, incidental, special or consequential loss. This clause does not limit liability that cannot legally be limited or excluded, including rights and remedies available under the Australian Consumer Law.

17. Changes to These Terms

We may update these Terms to reflect changes to the service, pricing, law, security or business operations. If a change materially affects your rights or obligations, we will take reasonable steps to notify users where appropriate. The updated version applies from the date shown at the top. If you do not agree with an updated term, you should stop using the affected service and cancel any recurring subscription before its next renewal.

18. Governing Law

These Terms are governed by the laws of Queensland, Australia, and applicable Commonwealth laws of Australia. Nothing in this section prevents you from relying on any mandatory rights or forum available to you under applicable consumer law.
